Please read this disclaimer in its entirety before using the Kairos platform.
Cryptocurrency markets are subject to unique risks that differ from traditional financial markets. By using Kairos, you acknowledge and accept the following risks:
- Volatility: Cryptocurrency prices can experience extreme volatility, with rapid price swings of 10% or more occurring within hours or even minutes. Such volatility can result in significant and sudden losses;
- Regulatory risk: Governments and regulatory bodies worldwide may introduce new regulations, restrictions, or outright bans on cryptocurrency trading, which could adversely affect the value of your holdings or your ability to trade;
- Liquidity risk: Some cryptocurrency markets may have limited liquidity, making it difficult to execute trades at desired prices, particularly during periods of high volatility;
- Technology risk: Cryptocurrency networks may be subject to technical failures, protocol changes, forks, network congestion, or security vulnerabilities that could affect the value or transferability of your assets;
- Exchange risk: Cryptocurrency exchanges, including Bybit, may experience downtime, security breaches, insolvency, or operational failures. Your funds on the exchange are subject to the exchange's own terms and security practices.
Kairos uses artificial intelligence (AI) agents powered by large language models to analyze market data and make trading decisions. You should be aware of the following AI-specific risks:
- AI can be wrong: AI models can make incorrect assessments of market conditions, leading to trades that result in losses. AI does not have perfect information and cannot predict the future;
- Past performance is not indicative of future results: Historical backtesting or prior trading performance of the AI system does not guarantee that similar results will be achieved in the future;
- Model limitations: AI models may not account for all market factors, black swan events, sudden news developments, or unprecedented market conditions;
- Latency and execution: There may be delays between the AI's decision and actual trade execution, during which market conditions may change materially;
- System dependencies: The AI system depends on third-party services (Anthropic Claude, Bybit API, data feeds) that may experience outages or degraded performance;
- Over-optimization: AI strategies may be susceptible to overfitting on historical data, leading to poor performance in live trading conditions.
The AI is an experimental tool. It should not be relied upon as the sole basis for any investment decision. Always exercise your own judgment and consider consulting a qualified financial advisor.
The information, analysis, and trading signals provided by Kairos are for educational and informational purposes only. Nothing contained in or provided by the Service constitutes:
- Investment advice, financial advice, trading advice, or any other form of professional advice;
- A recommendation or solicitation to buy, sell, or hold any cryptocurrency or financial instrument;
- A guarantee of any particular outcome or rate of return.
Before making any trading or investment decisions, you should consult with a qualified financial advisor who can assess your individual financial situation, risk tolerance, and investment objectives. Kairos is not registered as a financial advisor, broker-dealer, or investment advisor in any jurisdiction.
While Kairos employs AI agents designed to optimize trading outcomes, there is no guarantee that the Service will generate positive returns. You acknowledge that:
- The AI system aims to optimize risk-adjusted returns, but optimization does not mean guaranteed profits;
- Market conditions can render any trading strategy ineffective;
- You may experience losses, including the total loss of your invested capital;
- Risk management features (stop-losses, drawdown limits) reduce but do not eliminate the possibility of significant losses;
- Any performance figures, projections, or examples shown on the platform are illustrative only and do not represent a guarantee of future results.
Kairos requires API keys from your Bybit exchange account to execute trades on your behalf. While we implement security measures to protect your keys, you should be aware of the following:
- Kairos uses API keys configured with read and trade permissions only. Withdrawal access is never requested or required;
- Any API access carries inherent security risk, regardless of the permissions granted;
- You are responsible for ensuring your API keys are properly configured with the correct (restricted) permissions;
- You should regularly review and rotate your API keys as a security best practice;
- In the event of a security breach affecting our systems, API keys could potentially be compromised. You can revoke your keys at any time through your exchange account;
- Kairos is not liable for any unauthorized access resulting from vulnerabilities in the exchange platform itself.
Best practice: Create a dedicated sub-account on Bybit for use with Kairos. Only fund this sub-account with the amount you are willing to risk. Never enable withdrawal permissions on API keys provided to any third-party service.
Certain subscription tiers include a profit share component based on the performance of your portfolio. You should understand that:
- Profit share is calculated based on reported portfolio gains within the Kairos platform;
- Reported gains are calculated from paper trading or exchange-reported values and may not account for all fees, slippage, or market impact;
- Actual realized gains may differ from reported figures due to exchange fees, network fees, price slippage, and timing differences;
- Profit share calculations are subject to reconciliation and may be adjusted if discrepancies are identified;
- The existence of a profit share model does not imply that profits are likely or guaranteed.
To the maximum extent permitted by applicable law:
- Kairos, its operators, developers, affiliates, and service providers shall not be liable for any trading losses, lost profits, or financial damages arising from the use of the Service;
- This includes losses resulting from AI-generated trading decisions, system outages, exchange failures, or any other cause;
- Our total aggregate liability shall not exceed the total subscription fees paid by you to Kairos during the twelve (12) months preceding the claim;
- The Service is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory.
By using the Kairos platform, you confirm that:
- You understand the risks of cryptocurrency trading and AI-assisted trading as described in this disclaimer;
- Your decision to trade using Kairos is made voluntarily and based on your own judgment;
- You accept full responsibility for all trading outcomes, whether profitable or not;
- You are trading only with funds that you can afford to lose entirely without affecting your financial stability;
- You will independently monitor your exchange account and open positions;
- You will comply with all applicable laws and regulations in your jurisdiction regarding cryptocurrency trading;
- You have read and understood the Terms of Service and Privacy Policy.
By continuing to use the Kairos platform, you acknowledge that you have read, understood, and agreed to this Risk Disclaimer in its entirety. If you do not agree with any part of this disclaimer, you must discontinue use of the Service immediately.
